Surgical mesh problems and what you can do

Surigcla mesh problems

Suffering with surgical mesh problems can be absolutely horrendous to have to live with, and it can have an impact on every part of a victim’s life.

That’s why what we do is so important. Although we can’t turn back the clock and stop the suffering, we can use the law to claim compensation for any woman who has been affected by the vaginal mesh scandal.

Your options for a legal case are there, and we can offer No Win, No Fee arrangements for your protection.

Can you claim for surgical mesh problems?

You can be eligible to make a claim for personal injury compensation if you’re suffering with surgical mesh problems.

We must establish some form of negligence on another party. This could be inadequate advice about the risks and problems you could face, or it could be a product claim against the manufacturer if we consider the mesh to be defective or inherently dangerous.

As you may be aware, this is a worldwide scandal, and the UK has yet to fully ban the use of vaginal mesh. Whether a final ban will be initiated or not remains to be seen, but recently-revised guidelines have been heavily criticised for not taking into account the known long-term problem that many women have suffered.

What do you claim for?

You may be able to claim for the pain, suffering and loss of amenity caused by surgical mesh problems. You may also be able to claim for any losses and expenses, which can include lost earnings for time off work, and private treatment and surgery costs.

We normally instruct an independent expert to provide us with a medico-legal report, and we use this report to prove the case, and to value the claim. We also use your own witness testimony, and then any evidence of losses and expenses for the additional claim that’s usually known as “Special Damages”.

The injury side of the case is often referred to as “General Damages”.

What are the costs?

We can offer No Win, No Fee representation for surgical mesh problems. There are percentage deductions if a case wins, which is to recover fees that can no longer be sought from the other side due to changes in the law that took place a few years ago. The important thing, however, is that the No Win, No Fee options are there, and we’re also more than happy to advise about the process of claiming on an entirely no-obligation basis.

Feel free to get in touch for more information. We’re normally open seven days a week, and late on weeknights as well.
